Birth Injuries/Trauma

Doctors, nurses and hospital staff are expected to meet the appropriate standard of care when delivering a baby. Often, there are written procedures and standards addressing the monitoring of a baby and recognizing when a baby is in distress. When medical staff fail to follow these written standards and fail to follow the general standard of care birth injuries and trauma may occur. Such injuries and trauma include shoulder birth trauma, dystocia, and cerebral palsy.

Birth injuries can be caused by pre-term delivery, improper use of forceps, improper use of vacuum extractor, physician or hospital negligence, delay in recognizing or treating infections, delay in the decision to perform a cesarean section, and other medical mistakes in the labor and delivery room.

Shoulder dystocia occurs when an infant’s head has passed through the birth canal, but the shoulders remain caught behind a mother’s pubic symphysis. If a doctor delivers the baby without changing the position of the infant’s shoulder, damage to the brachial plexus nerves will result in Erb’s Palsy, Cerebral Palsy, Klumpke’s paralysis, or physical impairment.

Cerebral Palsy occurs because of oxygen deprivation to an infant during birth. Insufficient oxygen leads to developmental problems later in life and may not be clear in the early months or years after birth. Oxygen deprivation during birth can occur for several reasons including failure to properly monitor a baby’s or mother’s vital signs, infections or delivery mistakes.
